For example, Kenya Airways’ current Conditions of Carriage state that when it cancels a flight, fails to operate reasonably according to schedule, fails to stop at the passenger’s destination, or causes a passenger to miss a confirmed connection, it offers specified remedies including carriage at the earliest opportunity, rerouting or a refund under its conditions. Is a Delayed Flight the Same as a Cancelled Flight?

No.

A delay means the airline still intends to operate the flight, although later than scheduled.

What If the Airline Offers Another Flight?

Ask for the details before accepting.

When does it depart?

Is it operated by the same airline?

Will your checked baggage be transferred?

What happens to your connecting flights?

Does accepting the alternative affect any refund option?

If the new itinerary is substantially different, ask the airline to explain your available choices.

Can You Ask for a Refund Instead?

Depending on the circumstances and applicable airline conditions, yes.

What About a Hotel When the Flight Is Cancelled Overnight?

Again, do not assume every overnight cancellation automatically gives every passenger a free hotel.

Potentially, yes.

A mechanical problem, airline scheduling issue, severe weather, air-traffic restriction, security incident and airport closure are not necessarily treated identically under every compensation or liability regime.

What If the Flight Time Changes Before Travel?

  • transferred to the replacement flight;
  • returned to you;
  • retained for later transportation; or
  • retagged for a different routing.

Keep your baggage receipt until the journey and any baggage claim are completely resolved.

What If Your Baggage Is Delayed Too?

Passenger delay and baggage delay are related but separate issues.

The operating airline controls the flight, but a travel agent may have issued the ticket or collected payment.

Do not assume that being redirected to the agent means the airline is denying that the flight was cancelled.

Does the Montreal Convention Apply?

For qualifying international carriage, the Montreal Convention can affect airline liability for passenger delay and baggage issues.

Delay vs Missing Your Own Flight

Keep these situations separate.

If you arrive after check-in or boarding closes because you left home late, that is ordinarily a passenger-side missed-flight issue.

If the airline cancels your service or its earlier flight causes you to miss a protected connection, that is an airline-disruption issue.

The difference can completely change your options.
