Boda Boda Rider Denies Attempting to Defraud Jubilee Insurance Through Fake Accident Claim

NAIROBI, Kenya, Sep 4 — A boda boda rider accused of presenting a false road accident claim in an attempt to defraud an insurance company has pleaded not guilty before a Nairobi court.

Edwin Odhiambo Oduor was charged with conspiracy to defraud contrary to Section 317 of the Penal Code and insurance fraud contrary to Section 204B of the Insurance Act.

The prosecution alleges that between September 8 and October 11, 2023, Oduor conspired with other people who were not before the court to defraud Jubilee Insurance Kenya Limited.

According to the charge sheet, Oduor allegedly wilfully and knowingly presented a false claim seeking compensation for injuries and damages purportedly arising from a road traffic accident.

The court heard that he claimed to have been injured in an accident along Kangundo Road on September 8, 2023.

The alleged accident involved motor vehicle registration number KCT 239J, reportedly owned by Linus Kinyua Muthinga and insured by Jubilee Allianz General Insurance Company, and another vehicle registered as KBK 946C.

Prosecutors maintain that the accident claim was false. Oduor denied both charges.

The prosecution, through Central Police Station, listed six witnesses, including Jubilee Insurance representative Jack Njuguna, vehicle owner Linus Kinyua and investigating officer Detective Raphael Bosire.

Oduor was arrested without a warrant on September 3, 2026, and presented in court the following day under Police Case Number 141/121/2026.

While asking the court to grant him favourable bail terms, Oduor said he was a boda boda rider with no money and had pressing family matters requiring his attention.

The court released him on a cash bail of Sh100,000 pending the hearing and determination of the case.

The matter will be mentioned on a date set by the court for further directions.

The accused remains innocent unless and until proven guilty.
